What is an ADU ?
Per The Affordable Homes Act of 2024 —An ADU is an “Accessory Dwelling Unit”, which is a self-contained or separate housing unit that includes sleeping, cooking and sanitary facilities. An ADU shall be permitted on all single family lots in Massachusetts (with restrictions from each town/city) and must pass all MA building codes.
So what is allowed? Some single family homeowners can build a separate building or attach an addition (side or rear of home only), that does not already have an ADU or In-law. Of course you will need to hook up to water and sewer, just like existing house.
Most Importantly: This addition must be 50% of your current gross living area. Which means if you have a 1,200 sqft house right now, you can add a 600 sqft addition. Max allowable is 900 sqft and can contain up to 2 bedrooms (most towns). By-laws state it must be on a foundation and can never be separated or sold separately, and must have a separate parking space. No “Special Permit” should be required if you meet guidelines.
